Welcome to SailorPass (“we”, “us”, “our”). These Terms govern your use of the SailorPass website, application, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. About SailorPass

SailorPass provides a digital platform for sailors, coaches, and industry professionals to manage and verify sailing classifications in line with the SailorPass Classification Guide. Classifications may be assisted by automated systems and reviewed by authorised personnel before final confirmation.

2. Eligibility

You must be at least 16 years old to create an account. By registering, you confirm that the information you provide is accurate, complete, and truthful to the best of your knowledge.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login details and for all activity on your account.
  • You must not share your account or impersonate another person.
  • We reserve the right to suspend or terminate accounts that breach these Terms or involve fraudulent or abusive behaviour.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • submit false or misleading information in your application;
  • use the Service to harass, threaten, or defame others;
  • attempt to access systems or data you are not authorised to use;
  • copy, modify, or reverse-engineer any part of the Service.

5. Classification Decisions

SailorPass may use automated systems and human review to determine your classification (e.g., Personal, Industry, Elite). We aim to ensure decisions are fair, consistent, and transparent. You may request a review or appeal of your classification by contacting us at privacy@sailorpass.com.

6. Data Protection & Privacy

We process personal data in accordance with our Privacy Policy, which explains what data we collect, how it is used, and your rights under the UK GDPR and related laws. By using the Service, you agree to our Privacy Policy.

7. Intellectual Property

All content, design, code, and branding within SailorPass are the property of TTC Marine Ltd or its licensors. You may not reproduce, distribute, or adapt any part of the Service without prior written consent.

8. Availability and Changes

We aim to keep SailorPass reliable and available but do not guarantee uninterrupted access. We may update, suspend, or modify parts of the Service at any time for maintenance, security, or improvement reasons.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. While we take care to ensure accuracy, we do not guarantee that classifications or information displayed are error-free or suitable for every purpose. You use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential losses arising from your use of the Service. Nothing in these Terms excludes liability for fraud, gross negligence, or death/personal injury caused by our negligence.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms, misuse the Service, or act unlawfully.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
